Nourish Florida, a program of Feeding Florida, Inc. ("Nourish Florida," "we," "our," or "us"), is committed to protecting your personal information. This Privacy Policy explains what information we collect, how we use it, with whom we share it, and your rights regarding your data.
By participating in the Nourish Florida program or using our website, text messaging services, or other digital tools, you agree to the practices described in this policy.
Information We Collect

Program Eligibility Information: Medicaid enrollment status, health condition (for eligibility verification only), and food security status.

How We Use Your Information

Enroll and serve eligible program participants with home-delivered food boxes and nutrition education.

Information Sharing
We do not sell or rent your personal information — including your mobile number or messaging consent — to any third party, ever.
We may share your information only in the following limited circumstances:
Your Health Plan (MCO): With your knowledge and as required by program participation, we share relevant program engagement data with your Medicaid managed care organization to facilitate care coordination and reimbursement.
Service Providers & Subcontractors: We share information with trusted vendors who perform services on our behalf, including customer service platforms, secure messaging providers, electronic health record vendors, logistics and delivery providers, and telecommunications providers. These parties are contractually obligated to protect your information and may only use it to provide services on our behalf.
Feeding Florida Network Food Banks: Relevant delivery and contact information is shared with the local Feeding Florida member food bank coordinating your food delivery.
Legal Requirements: We may disclose information when required by law, subpoena, or other legal process, or to protect the rights, property, or safety of our participants, staff, or the public.
Data Security
We implement industry-standard security measures to protect your information from unauthorized access, disclosure, alteration, or destruction. All information is transmitted using SSL (Secure Socket Layer) encryption. Access to personal information is restricted to authorized personnel who need it to perform their job functions.
Data Retention
We retain your personal information for as long as necessary to provide program services, comply with legal obligations, resolve disputes, and enforce our agreements. Program participation records may be retained for up to seven (7) years following program completion to support outcome evaluation and reimbursement documentation.
SMS communications and associated data are retained for 24 months and then deleted, unless required by law.

Text Messaging & Mobile Information Privacy
We respect your privacy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All categories of personal information listed below are subject to this restriction.
How We Use Text Messaging
SMS Data Collection: We collect phone numbers and message content for SMS communications. Your phone number is used solely for delivering SMS messages related to the Nourish Florida program.
Messages may include:
Delivery notifications and scheduling reminders.
Program check-ins, surveys, and nutrition education prompts.
Health tips, goal-setting reminders, and benefit enrollment support.
Program updates and important operational communications.
Opt-In & Consent
Text message services are only provided to individuals who have affirmatively opted in to receive them. By providing your mobile number and consenting to text messages, you agree to receive program-related communications from Nourish Florida.
Message Frequency
Message frequency varies by program phase. You may receive up to 2–4 messages per week during active program participation.
Message & Data Rates
Standard message and data rates from your mobile carrier may apply. Nourish Florida does not charge for text messages.
How to Opt Out
Reply STOP to any message at any time to unsubscribe. Reply HELP for assistance, or contact us directly.
Text Messaging Opt-In Data Protection
We are committed to protecting your text messaging consent and opt-in information. The following rules govern how this data is handled:
All text messaging originator opt-in data and consent information will not be shared with any third parties, excluding aggregators and providers of the text message services used to deliver messages on our behalf.
We do not sell or rent personal information, including mobile numbers or messaging consent, to third parties.
Information sharing with subcontractors in support services — such as customer service platforms, secure messaging platforms, electronic health record vendors, and telecommunications providers — is permitted as necessary to provide services on our behalf. Such subcontractors are bound by data protection obligations consistent with this policy.
TCPA Compliance: We comply with the Telephone Consumer Protection Act (TCPA) and maintain a list of numbers requesting not to receive marketing messages.

Health Information & HIPAA
Protected Health Information
Nourish Florida collects and uses certain health-related information (such as your chronic condition diagnosis) to determine your eligibility and tailor program support. To the extent this information constitutes Protected Health Information (PHI) under the Health Insurance Portability and Accountability Act (HIPAA) and its implementing regulations, it will be handled in compliance with applicable HIPAA requirements.
We maintain a unified HIPAA compliance policy across the Feeding Florida network for all program operations. This includes data handling, electronic communications, delivery logistics, and third-party vendor management.
Coordination with Your Health Plan
As a program operated in partnership with Medicaid managed care organizations, certain program participation data (such as enrollment status, delivery completion, and engagement metrics) may be shared with your health plan for care coordination and program reimbursement purposes. This sharing is governed by applicable agreements between Nourish Florida and your health plan and occurs as permitted under HIPAA for treatment, payment, and healthcare operations.
Minimum Necessary Standard
We limit access to health-related information to the minimum necessary to carry out the intended purpose. Staff and vendors with access to PHI are trained on privacy and security requirements and are subject to confidentiality obligations.
