Acceptance of Terms
By enrolling in the Nourish Florida program, accessing our website, or using our text messaging services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not participate in the program or use our services.

These Terms are administered by Feeding Florida, Inc. ("Feeding Florida"), a Florida nonprofit corporation and the statewide network of food banks, which operates Nourish Florida in partnership with local member food banks and healthcare partners.

Program Eligibility & Enrollment
The Nourish Florida program is available to individuals who meet all of the following criteria:

Enrolled in a participating Florida Medicaid managed care plan.
Experiencing food insecurity.
Managing a qualifying diet-related chronic condition (including, as applicable, Type 2 Diabetes, Hypertension, or Congestive Heart Failure), and/or are pregnant or postpartum.
Residing within a participating service area.

Eligibility is determined by your health plan and Feeding Florida based on pre-approved referral lists. Enrollment is subject to program availability and capacity.

Program Participation

By enrolling, you agree to:

Provide accurate and complete information during enrollment and throughout the program.
Notify Nourish Florida of any changes to your address, contact information, or program eligibility.
Participate in program surveys and feedback activities to the extent reasonably requested.
Use program resources (food boxes, nutrition education materials) for your personal and household use only.
Allow Nourish Florida to share de-identified or aggregated program data with your health plan and for program evaluation purposes.

SMS & Text Messaging

The following terms govern your use of and consent to Nourish Florida text message (SMS) communications. These terms supplement the Text Messaging section of the Privacy Policy above.

SMS Consent: By providing your phone number, you agree to receive SMS messages from us. Standard messaging rates may apply as determined by your carrier.

Message Frequency: We send approximately 2-4 messages per week. Message frequency may vary.

Withdrawal of Consent: You may withdraw consent to receive SMS messages at any time by replying STOP or emailing support@nourishfl.com.

Dispute Resolution: For issues or disputes regarding SMS communications, contact us at support@nourishfl.com or +1-850-270-3429. We will respond within 3 business days.

Program Duration & Services

The standard Nourish Florida program is delivered over a six-month period. Services include bi-weekly home delivery of healthy food boxes, nutrition education materials, and periodic check-in communications. Specific program components may vary based on your health plan and local food bank partner.

Nourish Florida reserves the right to modify, suspend, or discontinue program services at any time, with or without notice, due to funding changes, regulatory requirements, or operational constraints. We will make reasonable efforts to notify enrolled participants of material changes.

Limitations of Service
Nourish Florida is a food and nutrition support program. It is not a medical service, and participation in the program does not constitute or replace medical advice, diagnosis, or treatment. Participants should continue to follow the guidance of their licensed healthcare providers.

Nourish Florida does not guarantee specific health outcomes as a result of program participation.

Acceptable Use

You agree not to:

Provide false, misleading, or fraudulent information to obtain program benefits.
Sell, transfer, or distribute program food resources to third parties for commercial purposes.
Interfere with or disrupt the program's operations, delivery logistics, or digital services.
Use program communications channels for purposes other than program participation.

Violation of these terms may result in removal from the program and, where applicable, referral to appropriate authorities.

Intellectual Property
All content, materials, and branding associated with Nourish Florida, including the program name, logo, nutrition education materials, and website content, are the property of Feeding Florida, Inc. or its licensors. You may not reproduce, distribute, or use these materials for commercial purposes without prior written consent.

Limitation of Liability
To the fullest extent permitted by applicable law, Feeding Florida, Inc. and its member food banks, officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your participation in the Nourish Florida program or use of our services.

Our total liability to you for any claims arising under these Terms shall not exceed the value of program services provided to you in the three (3) months preceding the claim.

Governing Law
These Terms of Service are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Leon County, Florida.

For disputes specifically regarding SMS communications, the dispute resolution process outlined in the SMS & Text Messaging section above applies and should be exhausted prior to initiating formal legal proceedings.

Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

Updates to Terms
We reserve the right to update these Terms at any time. Continued participation in the program following notice of updated Terms constitutes your acceptance of the revised Terms.
